TERMS & CONDITIONS

ENICOM NETWORK AND DATA SOLUTION

1. Introduction

Welcome to ENICS. By subscribing to, accessing, or using our internet services (“Service”), you agree to be bound by these Terms & Conditions.

If you do not agree, please discontinue use of the Service.

2. Service Description

We provide internet connectivity via [Fiber/Wireless/Hybrid].

Advertised speeds are “up to” the stated bandwidth and may vary due to network/weather conditions.

Service availability may depend on installation feasibility, signal strength, or infrastructure limits.

We aim to maintain stable service up to 90% uptime currently and aiming on higher upgrades.

3. Installation & Equipment

Installation fees must be settled after installation on your houses.

All equipment provided (ONU, router, CPE, power supply, mounts) are yours unless applying for higher upgrades.

Subscribers must provide safe installation conditions and allow access for repair or maintenance.

Tampering, unauthorized relocation, or modification of equipment is prohibited.

4. Billing & Payments

Billing is monthly.

Payments must be made on or before the due date.

Auto Cut are applied every exact due date at exactly 5pm.

Non-payment may result in automatic disconnection without further notice.

Reconnection fees apply for 3 month past-due accounts amounting to 300 pesos.

All unpaid balances must be cleared prior to reconnection.

5. Acceptable Use Policy

You agree NOT to use the Service for:

  • Illegal activities (as defined by Philippine law).
  • Distribution of copyrighted content without permission.
  • Hosting malicious services (spam, attacks, open proxies).
  • Bandwidth resale or redistribution without our authorization (Example Pisowifi).
  • Activities that may disrupt our network or other subscribers.

Violation may result in service suspension or termination.

6. Service Interruptions & Maintenance

Planned maintenance may cause temporary interruptions; we may announce these in advance when possible.

Outages caused by weather, power failure, fiber cuts, tower issues, or third-party problems are sometimes unavoidable.

Billing will be adjusted upon validation of our team.

7. Fair Use & Bandwidth Management

We may apply Fair Use Policies to protect network quality.

During congestion, temporary speed shaping or prioritization may occur.

8. Subscriber Responsibilities

Subscribers must:

  • Protect provided equipment from damage or theft.
  • Use secure Wi-Fi passwords and avoid sharing account access.
  • Report service issues promptly.
  • Keep their local network safe from unauthorized users.

Any misuse originating from the subscriber’s network is the subscriber’s responsibility.

9. Termination of Service

Your subscription is month-to-month unless stated otherwise.

We may suspend or terminate the Service if you:

  • Fail to pay your bills
  • Violate these Terms
  • Engage in illegal activities using the Service

10. Limitation of Liability

We are not liable for:

  • Loss of income or business due to service interruptions
  • Data loss or damage
  • Issues caused by your own equipment (PC, router, wiring)
  • Damages from power surges, acts of nature, accidents, or events beyond our control

Our maximum liability is limited to the amount you paid for one month of service.

11. Privacy & Data Protection

We comply with the Data Privacy Act of 2012.

Minimal logs may be collected for security, troubleshooting, and regulatory compliance.

We do not sell or share your data.

12. Updates to the Terms

We may update these Terms & Conditions at any time.

Continued use of our Service constitutes acceptance of the updated Terms.
